Section 181 of the Evidence Act 2011 Provides as Follows:
In any criminal proceedings, where a defendant has not given evidence, the court, the prosecution or any other party to the proceedings may comment on the failure of the defendant to give evidence but the comment shall not suggest that the defendant failed to do so because he was, or that he is, guilty of the offence charged.
